On October 30, 2012, an amendment to the Holiday Lake Estates Civic Club Bylaws was filed with the Polk County TX Clerk’s office. The very first problem with this amendment is that it includes wording that is not part of the operation of the HLECC Board. It is important that you understand that the Bylaws govern the HOA corporation and board members only, they SHOULD NOT include any property deed restrictions. You can view this document –> Here . When the proposal to make this amendment to the Bylaws was declared on 7/28/2012, it was to be read again in the August meeting. The 8/24/2012 meeting minutes state “Second reading of bylaws, read by John. No changes per Board or visitors. Third reading and Vote on amendments at Septembers meeting.” The September meeting made no reference of a third reading or a vote. (see image below) I also checked the October 27th meeting minutes. It did not have any reference to a vote either and according to Robert’s Rules – notations of any votes is mandatory in meeting minutes. Since I was given these meeting minutes, along with other documents, in my 7 year of records request, I doubt if these are not the correct meeting minutes. So, I am left with only one question – was this amendment filed legally?
