Abuse Of Power

At Monday night’s HOA meeting, residents spoke out against the board. One man said, “Shame on you. Shame on you board members.” “I mean, it’s just wrong,” homeowner Judith King told 10News outside the meeting. “It’s wrong.”  Neighbors said Evolfo applied for a city permit to build a backyard “deck” before receiving HOA approval. After getting the permit, the HOA president called an emergency HOA meeting solely for a vote on his “deck.” Fellow board members approved construction. –> Read Complete Story

HOA Turns Down Golf Course Bailout

By Ed Pearce SPARKS, NV – The Truckee Meadows may have just lost another golf course. The owner of the D’Andrea Country Club in East Sparks says he’s closing the course “immediately and permanently.” Owner Will Gustafson says he made the decision following a 762-200 vote by members of the D’Andrea Homeowners Association rejecting his proposal for a $28 dollar a month per household fee to maintain the course. –> Read Complete Story Here

Poop-Scooping In Home Owner Associations

An older news article, brought up some thoughts about my own homeowner association members: By Justin Jouvenal A dispute between neighbors in Fairfax County over that perennial suburban pet peeve — unscooped dog poop — has grown so big that the case is set to go to a jury Tuesday. The case is just one flash point in an increasingly sophisticated, expensive and acrimonious battle over dog waste in the Washington suburbs and beyond. Two Northern Virginia apartment complexes have signed on for PooPrints, a service that collects DNA samples from pooches, taking a “CSI”-style approach to find the culprits … Click Here For Entire Entry

HOA Dispute Causes Community Activism

By Kathleen Stinson Since the Cortina Homeowners Association board of directors cut down more than 20 trees in the Queen Creek community’s common areas and parkways — with plans to cut down more than 100 more — without notifying or including the residents in the process, some residents have taken steps to become more involved as members. The community is having an election to fill four board member seats Wednesday and the ballots will be counted at 7:30 p.m. at Cortina Elementary School in Queen Creek. Four residents challenging the status quo are among eight candidates on the ballot. When … Click Here For Entire Entry

Homeowner Association Corrupt Board Management?

By J. Patrick Coolican This story begins late last year, a few days after I wrote a column warning readers to pay attention to the actions of their homeowners association because they can be manipulated by unscrupulous board members and property managers or overrun by incompetence. With significant maintenance costs coming and years of revenue shortfalls from the foreclosure crisis, many HOAs face dark days ahead. Casablanca is mired in a bitter battle for control of the board, with some residents complaining of financial mismanagement and petty corruption. The dissidents say board President Mary Ann Berry hired an unlicensed contractor … Click Here For Entire Entry

Video-Conferencing Homeowner Association Meetings

By Joe Adams Question: Our homeowners’ association is wondering if video conferencing is official attendance for a quorum at an annual meeting and if people can vote by video participation. Our board has been voting at their monthly meeting issues via video means and this has not seemed to cause any problems, but we need to know if it is binding for annual meeting votes. Answer: I assume that your directors currently participate in board meetings via one of the popular computer/online services that allow users to communicate with others by voice, video, and instant messaging over the Internet. HOA Voting Is Important

By Joan Rusek The Tanglewood Lake Association board hoped it would be a chip shot onto the green to purchase the $1-million, 132-acre golf course from its owners, Birmingham Associates, LLC. According to the plan, Birmingham Associates will continue to operate the golf course. The homeowners association will gain control of the property to avoid unwanted development. TLA is learning large real estate transactions can be as complicated as the game of golf. In a matter of days, TLA will have a purchase agreement in place and a lease agreement for Birmingham Associates to run the golf course, according to … Click Here For Entire Entry

Preparing For HOA Annual Meeting

By Stan Riddle Over the next few months, a number of homeowner associations will be holding their annual meetings. Of all of the HOA meetings held during the year, this one probably has the most members in attendance due to a number of important issues that are likely on the agenda, such as election of officers. In an effort to assist HOAs in making this meeting run both effectively and efficiently, the Green Valley Council offers a few suggestions: –> Read Complete Story Here

Majority Vote Rule In Washington

By Stevie Mathieu Because of foreclosures, banks and other corporations now own 40 percent of the townhomes in Rich Freedman’s Vancouver neighborhood. In addition to being a depressing statistic, it also has made it nearly impossible for Freedman’s homeowners’ association to get enough members at meetings to make important decisions about the neighborhood. The homeowners’ association has a rule that 50 percent of homes must have an owner present at the meeting before voting on any big rule changes, and the corporations won’t attend their homeowners’ meetings. “We’ve been unable to even elect officers,” Freedman said during a state Senate … Click Here For Entire Entry

HOA Member Language Barriers

By Stephen Glassman and Donie Vanitzian Question: We are a small homeowners association over 35 years old. As original owners sold their units, our association demographics changed. Our association is now composed of various cultural groups speaking several different languages and dialects. The majority of current owners cannot read our covenants, conditions and restrictions and other governing documents. They show no interest in the association. As a result, we no longer have a board of directors. The last board meeting minutes were published just before the secretary sold his unit and moved away last year. Of the two English-speaking owners … Click Here For Entire Entry
